The author discusses a special type of valuation discrimination in Texas relating to the assessments of chain restaurants as a class of property, based on the principal appraisal method being used-the cost approach.

In the Dallas/Fort Worth area, fast food chain locations sell for a fraction of their original construction cost because they no longer operate as chain restaurants or because they are sold to second generation non-restaurant-chain operators. Texas appraisal districts, however, tend to take the opposite approach. That approach is a dollar spent equates to a dollar of taxable market value, so how do you prove that the districts are wrong? Can one prove that the cost approach is not the best approach to use when valuing chain locations? Doesn?t the cost approach really determine the fee simple taxable market value of a chain restaurant? Is it true that the income and the sales comparison approaches may not be appropriate in valuing a new chain property? How do appraisal districts measure the going concern value of a chain restaurant? These are some of the questions that are discussed in this article.

VALUING CHAIN~THE COST APPROACH

Is it safe to assume that the cost approach is the best approach to use when valuing a chain restaurant? The answer in this author?s estimation is, no. The cost approach should be challenged as the exclusive method of determining the taxable realty value of chain locations. Further, the other two approaches to value, income and sales comparisons, should be modified to truly appraise the taxable restaurant market. In the third quarter, 1990 issue of the Enterprise Valuation Reporter, John D. Emory, value points out that:

Business valuation has to do with the value of the rights inherent in ownership of a commercial, industrial or service organization pursuing an economic activity. Real estate appraisal involves the valuation of land, improvements and associated rights. Real estate appraisal does not deal adequately with the whole area of intangible business assets such as patents, trademarks, copyrights, goodwill, customer lists, employment contracts, covenants not to compete, exploration rights, intangible drilling costs, franchises and licenses. The more a company depends on its intangible assets to generate earnings, the more important such assets are in any business enterprise value. Robert Reilly notes in the January 1993 issue of Valuation, published by the American Society of Appraisers, that:

Traditionally, real estate appraisals of location-dependent commercial encompass a portion of (if not all of) the intangible business enterprise value of the property. . . . The naive application of real estate appraisal procedures to location-dependent businesses will ignore the fact that the real property?s highest and best use (and total concluded value) are dependent upon the existence and assemblage of such location-specific intangible assets as business licenses, certificates, permits, and franchises and such non-location-specific intangible assets as a trained and assembled workforce, goodwill, and going concern value. Therefore, by including an economic contribution from these intangible assets, the real estate appraisal may overstate the true market value associated exclusively with the subject ?bricks and sticks? for these location-dependent businesses.

It has been this author?s experience that Texas appraisal districts believe the primary approach to valuing chains is the cost approach; that is, the acquisition cost of the land plus the cost of personal property, plus the hard and soft costs of the improvements, less accrued depreciation, represent the taxable market value of a chain restaurant. The theory apparently relies heavily on the principle of ?substitution,? which The Appraisal of Real Estate, published by the American Institute of Real Estate Appraisers, defines as:

The principal of substitution is basic to the cost approach. This principal affirms that no prudent investor would pay more for a property than the cost to acquire the site and construction improvements of equal desirability and utility without undue delay. . . . Because cost and market value are closely related when properties are new, the cost approach is important in estimating the market value of new or relatively new construction. The approach is especially persuasive when land value is well supported and the improvements are new or suffer only minor accrued depreciation and, therefore, represent a use that approximates the highest and best use of the land as though vacant.

The invention of the wheelchair has made a great contribution to the lives of handicapped people. Whose business lunch is it anyway?

Most restaurant workers have worked lunches. We've each served countless customers conducting business while eating lunch. In my early years, business lunch customers seemed to be more of an inconvenience than an opportunity. It was difficult to offer service when they constantly talked.

One day, a coworker was waiting on two airline pilots. They were discussing the shortage of good flight attendants. My friend, the waitress, asked what it would take to try and become a flight attendant. A few weeks later, she was leaving to begin her training with a well known regional airline.

Being a flight attendant may or may not be your dream job. The point is, that your next job, career, business opportunity, etc. may be right in front of you ordering the Grilled Salmon.

Restaurant employment (or any customer service job) allows us the opportunity to serve hundreds or thousands of customers a year. Each one of these customers is a potential employer, business partner, reference, etc. Keep your eyes and ears open for opportunity. When the opportunity presents itself to have a discussion with a customer about their line of work, listen and learn. Find a way to let them know that you're open to new possibilities for employment.

Almost every customer you provide service to has a job or career. Each of these people may know of an opening within their company or be looking to hire someone themselves. Because you've provided exceptional service to them, they may love to talk more with you about it. If a customer gives you a lead on a job, make sure to ask if you can use them as a reference.

Many of your customers are also meeting and networking with others during lunch and dinner. Much like you probably work as a team in your job, these people exhibit the skills of teamwork. Begin to pay attention to the business cards being exchanged during these meetings. If a customer offers you a business card for any reason, I recommend sitting down that day and writing a card to let them know you appreciate their patronage and, in addition, what your aspirations are. You could receive a call or email from them letting you know they'd like to refer you to someone or talk more about a possible opportunity with them.

Another explosive industry is Network Marketing. You may have witnessed people viewing a small flip chart presentation in your restaurant. Many Network Marketing Companies use a 20 minute flip chart presentation to introduce potential business partners to their industry. These companies offer an enormous variety of services, such as skin care, vitamins, greeting cards, scrap-booking, prepaid legal, etc. The start up cost is minimal (usually $100-$400). The key is to find a product or service that you can be passionate about, and you're a business owner! Never hesitate to approach a customer and ask about what they're presenting... network marketers are ALWAYS looking for motivated business partners.

The opportunities within your restaurant or customer service job are endless. Today is a great day to begin looking and listening for those opportunities. Keep your ears and eyes open and while you're there, continue to give the best service you can. You'll never know if the customer asking for a special request is actually interviewing you to see if you would be perfect to head up a new division at YOUR DREAM JOB INCORPORATED!

In this second part in our series on the history of chairs we are going to continue with medieval chairs.

Maximianus, who was Roman emperor from 286 to 305, had a chair that now stands in the Cathedral of Ravenna. The chair is made of marble, is round, with a high back, and is carved with figures of saints and scenes from the Gospels and the Adoration of the Magi as well as the flight into Egypt by the Jews and the baptism of Jesus Christ himself. This chair is a truly amazing piece of art and craftsmanship. The smaller pieces of the chair are filled with carvings of animals, birds and flowers.

Another very ancient chair is the Chair Of Dagobert which is now in the Louvre. It is made of bronze and sharpened with a chisel. The chair is of the curule and is supported on legs that are made in the shape of heads and feet of animals. The seat of the chair was probably made of leather but is now totally gone. The age of the seat has been debated for some time now. Viollet-le-Duc dated it to early Merovingian times. It may very well be the oldest curule in existence today.

Of this same type of chair is the famous abbots' chair of Glastonbury. These chairs had the ability to be broken down into pieces when their owners traveled. In time, these chairs eventually acquired arms and a back and yet still retained their ability to be folded up and transported. The most famous of these chairs is the one belonging to Edward I of the 13th century. All subsequent monarchs have been crowned in that chair. The chair was made of oak and covered with gilded gesso which is long gone.

It is evident from these historic examples that these great chairs passed on from ruler to ruler. These were seats of authority and sat either at the ruler's table, by his bed side or on his dais. The seigneurial chair, which is most common in France and The Netherlands, is a very interesting type of chair. It had a very high back and was sometimes covered with a canopy. The lower part of the chair was carved on the sides and in front. The seat was sometimes hinged and closed with a key. A very unique chair indeed.

Historians have noted how we still sit in armed chairs similar to those from this period of time and how we in turn also sit in our so called chair of authority even if we are only common people. They refer to a normal dinner where the head of the household, usually the man, sits at the head of the table. The only difference in most cases is that dining room sets don't have one chair that stands out from the others, though some people will actually go through the trouble of getting a special chair for the head of the table as a symbol of authority. This is more common in the Eastern world than in the West.

In this next article in our continuing history of chairs we're going to pick up with Chinese chairs.

There is not much known about ancient Chinese chairs. What we do know is that during the Tang dynasty, which was from 618 to 907 AD, higher seats started to appear among the Chinese elite and then soon spread to the more common people of China. By the 12th century, sitting on the floor, which at one time was what every Chinese person did, was becoming less common even though in other Asian countries the custom of sitting on the floor continued.

We then move on to the Renaissance period. In Europe especially, it is because of the Renaissance period that the chair became a symbol of authority in the European State. It became custom that the only people who had chairs were those of authority or royalty or those who could simply afford them as they were very expensive. However, once the idea of privilege faded away, the chair became more common in everyone's household.

Once chairs started to be manufactured for common people it was immediately noticeable that the chairs themselves reflected the fashions of the times. Over the course of the Renaissance period chairs have varied in size, shape and sturdiness. They were fashioned not only after women's dress but after men's as well. The chair itself started to become too monstrous with many of the items they were adorned with and soon these items started to disappear in order to make the chair more functional.

By the 18th and 19th centuries the costly adornments of these chairs were threatened by the ordinary adornments of the more common chairs. Because of this came the development of the "conversation chair" which enabled the person sitting in it to sit with his face to the back of the chair. This can actually still be done with many chairs even today. The earlier chairs usually had large arms and it wasn't until the end of the 16th century that the smaller chairs became common.

The majority of chairs in the 17th century were made of oak and were made without upholstery. When it became fashionable to cover them, most of the time leather was used. Sometimes velvet and silk were also used. During later periods, less costly materials were used.

An old Abraham Bosse engraving from around 1630 depicts a Parisian musical party that has pulled their low chairs, which were called backstools, away from the tapestry hung walls where they were usually lined up. The padded back panels were covered with needlework panels. Plain cloth was put across the back to hide the wooden framing. The engraving also depicts stools with column legs.

Leather began to be used only for the most costly and elaborate chairs. These chairs were sheathed in thin plates of silver and were usually sent from Venice to other places all over Europe. To this day, leather is still the most infrequently used material for chairs. Until the 17th century the main characteristic of chairs was to be made sturdy and bulky. After the time of Louis XIII, chairs were made with cane backs and seats and their weight was reduced substantially.
